1. Definitions
In these Terms and Conditions, the following terms have the meanings assigned below:
- "Azurelle," "we," "us," or "our" refers to the yacht charter service operating in Krabi, Thailand.
- "Guest," "you," or "your" refers to the individual or party booking a charter.
- "Voyage" or "Charter" refers to the yacht rental service, including all associated activities and provisions.
- "Agreement" refers to these Terms and Conditions along with any booking confirmation.
2. Acceptance of Terms
By booking a charter with Azurelle, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not proceed with a booking.
You must be at least 18 years of age to enter into this agreement. By booking, you confirm that you have the legal capacity to do so.
3. Booking and Payment
3.1 Booking Process
Bookings are confirmed upon receipt of a deposit as specified during the booking process. The booking confirmation will include voyage details, pricing, and payment schedule.
3.2 Payment Terms
A deposit is required to secure your booking. The remaining balance is due before voyage departure as specified in your booking confirmation. Payment can be made via bank transfer or cash in Thai Baht. All prices are quoted in Thai Baht (THB).
3.3 Pricing
Prices are subject to change until booking is confirmed with deposit payment. Confirmed bookings are honored at the agreed price even if subsequent price adjustments occur.
4. Cancellation and Refunds
4.1 Guest-Initiated Cancellation
If you need to cancel your booking, please notify us as soon as possible. Cancellation policies vary by voyage type and timing:
- More than 14 days before departure: Full refund minus 10% administrative fee
- 7-14 days before departure: 50% refund
- Less than 7 days before departure: No refund
4.2 Weather-Related Cancellation
If we determine that weather conditions make safe operation inadvisable, we will work with you to reschedule or provide a full refund. This decision rests with our captain based on current conditions and forecasts.
4.3 Operational Cancellation
If we need to cancel due to mechanical issues or other operational factors beyond our control, we will offer rescheduling or a full refund. We are not liable for consequential expenses such as accommodation or travel arrangements.
5. Guest Responsibilities
5.1 Conduct
Guests are expected to conduct themselves in a manner that ensures safety and enjoyment for all aboard. The captain has final authority regarding conduct and safety matters. Behavior that endangers safety or disrupts the voyage may result in termination of the charter without refund.
5.2 Health and Fitness
Guests should inform us of any medical conditions, mobility limitations, or dietary requirements that might affect their voyage. While we make reasonable accommodations, certain activities may not be suitable for all fitness levels.
5.3 Property Care
Guests are responsible for damage to vessel property resulting from negligence or misuse. We may charge for repairs or replacement of damaged items.
6. Safety and Liability
6.1 Safety Procedures
All guests must comply with safety instructions provided by the crew. This includes wearing life jackets when required, following swimming and snorkeling guidelines, and adhering to vessel movement protocols.
6.2 Assumption of Risk
Marine activities involve inherent risks. By participating, you acknowledge these risks and assume responsibility for your own safety within the parameters of our provided safety measures and instructions.
6.3 Limitation of Liability
Azurelle maintains appropriate insurance and takes all reasonable precautions for guest safety. However, we are not liable for personal injury, loss, or damage to property except where caused by our proven negligence. Our liability is limited to the charter fee paid.
7. Voyage Itinerary
While we aim to follow planned itineraries, routes and schedules may be adjusted based on weather conditions, sea state, or other factors affecting safety and comfort. The captain has final discretion regarding route selection and timing.
We are not responsible for inability to visit specific locations due to conditions beyond our control. Alternative locations of similar interest will be offered when possible.
8. Personal Belongings
Azurelle is not responsible for loss or damage to personal belongings brought aboard. Guests should secure valuables and understand that marine environments can affect electronics and other sensitive items.
9. Photography and Media
We may photograph or video record aspects of charters for promotional purposes. By booking, you consent to such recording and use of images in which you may appear. If you prefer not to be photographed, please inform us before departure.
10. Privacy
Personal information collected during booking is handled according to our Privacy Policy. We use this information solely for charter coordination and related communications.
11. Force Majeure
We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including severe weather, natural disasters, government restrictions, or other force majeure events. In such cases, we will work with you to reschedule or provide a refund as circumstances allow.
12. Dispute Resolution
If you have concerns about your voyage, please raise them with our crew or management immediately so we can address them promptly. Most issues can be resolved through direct communication.
Any disputes that cannot be resolved informally will be governed by Thai law and subject to the jurisdiction of courts in Krabi Province, Thailand.
13. Modifications to Terms
We may update these Terms and Conditions periodically. Changes apply to bookings made after the effective date of the update. We will notify guests with existing bookings of any changes that materially affect their charter.
14. Entire Agreement
These Terms and Conditions, together with your booking confirmation, constitute the complete agreement between you and Azurelle regarding your charter. Any modifications must be made in writing and agreed upon by both parties.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
